Motorola granted injunction against iCloud in Germany

Motorola has just scored a couple of key victories against Apple in the latest round of the infamous patent war. Apple’s appeal to revert the injunction on push notifications in iCloud and MobileMe has failed. This is because the feature is covered by patents owned by Motorola.

This means that not just German citizens, but also tourists will be left without push email notifications on Apple’s iCloud and MobileMe services within German borders. Apple was also ordered by the German court to pay an unspecified amount of damages to Motorola.

The global legal system has finally ruled against Apple, ruling in favour of Motorola

Apple issued this statement on their support pages soon after:

“Due to recent patent litigation by Motorola Mobility, iCloud and MobileMe users are currently unable to have iCloud and MobileMe email pushed to their iOS devices while located within the borders of Germany.

Affected customers will still receive iCloud and MobileMe email, but new messages will be downloaded to their devices when the Mail app is opened, or when their device periodically fetches new messages as configured in iOS Settings. Push email service on desktop computers, laptop computers, and the web is unaffected, as is service from other providers such as Microsoft Exchange ActiveSync.”

Apple, like any other company, is remaining stubborn in the belief that they did nothing wrong, saying that “Motorola’s patent is invalid” and will again appeal the German court’s decision.
